Protection Visa subclass 866

Australia is a signatory to the 1951 Refugee Convention and the 1967 Protocol (www.UNHCR). This means Australia has the obligation to comply with these international treaties and to take its responsibilities to accept refugees in good faith.

Protection visa 866 is a permanent visa, allowing applicants to live and work in Australia as a permanent resident, also having access to Australian social entitlements at Centrelink and Medicare services. This visa is for individuals who didn’t arrive in Australia illegally through an unauthorised maritime or air travel.

 Who can be considered as refugees?

As defined by the 1951 Refugees Convention , a refugee is an individual who cannot return to their home country due to well-found fear of persecution because of race, religion, nationality, political opinion or membership of a particular social group. They may apply for a protection visa , if there is a serious harm to them if they return to their home country. The harm may include:

  • A death penalty
  • An arbitrary deprivation of life
  • Fear of cruel or inhuman treatment
  • Spiritual or physical torture or degrading punishment

 Eligibility Criteria for a Protection Visa

You may consider applying for this visa if:

  • You believe they are a refugee, as defined by the Refugee Convention or meet the Complementary Protection criteria in the Australian Migration Act 1958;
  • You are onshore in Australia on a valid visa and not through illegal marine or unauthorised air arrival;
  • You meet Australia’s protection obligations;
  • You are appealing for the protection;
  • You prove that the purpose of getting this visa is in national interest;
  • You meet the character and health requirements;
  • You need to identify yourself;
